FAZ gives Warriors 45 days to refund Lusaka Dynamos about K200,000 or face a ban

Super Division side Kabwe Warriors FC have been given 45 days by the FAZ player status committee (PSC) to refund Lusaka Dynamos Football Club US $6,000 (K99,438.14) and K90,000 over Akakulubelwa Mwachiyaba or face a ban of two windows without signing players.

On December 15, 2020, Mwachiyaba indicated willingness to join Dynamos upon expiry of his contract with his then club, Warriors which had less than two months to run.

On January 2, 2021, Dynamos and Mwachiyaba concluded a pre-contract agreement for the transfer. Upon signing the contract, Mwachiyaba requested to be paid his signing-on fee and part of his salary as an advance to ensure his relocation from Kabwe to Lusaka.

Mwachiyaba was then paid US$6,000.00 as first installment on his signing-on fee and an additional K90,000.00 as an advance against his salaries for the month of February, March and April 2021.

Following this, Dynamos approached Warriors to release the player earlier than the expiry date in his contract with the former offering to pay a transfer fee for the player.

However, on January 27, and February 8, 2021, Dynamos learnt through the press that the player had signed another contract with Warriors.

This led to Dynamos trying to recover the money paid to the player but failed, hence in October 2021, the club officially lodged a complaint with the FAZ general secretary seeking the association’s intervention in the matter.

Following the complaint, FAZ wrote to both the player and Warriors, asking the two parties to explain themselves over the allegations leveled against them.

The player, through his letter dated October 4, 2021 acknowledged details of the transaction as alleged but categorically stated that Warriors had promised to refund Dynamos all the money he was paid.

And Warriors, through its letter dated October 4, 2021, confirmed that Mwachiyaba had requested them to refund Dynamos all amounts due, which the club agreed to do so, but alleged that the player was induced into signing the contract.

But in a judgment past by the committee on December 6, 2021, Lieutenant Colonel Sikaaswe Syasayi, sitting as a single judge ordered Warriors to pay the claimant $6,000.00 and K90,000.00 as outstanding amounts plus five per cent interest per annum, starting January 2, 2021 until the effective payment.
