I can exclusively reveal that The Court of Arbitration for Sport in Switzerland has officially closed Kalusha’s appeal case against FAZ following his failure to pay the balance of the deposit for costs as directed.
On 29th May 2020, Kalusha Bwalya informed CAS, through his lawyers, that he was not going to pay the deposit because his request for suspension of proceedings was not granted.
According to CAS rules, if the deposits are not paid, the case is deemed withdrawn.

Consequently, CAS has written to Kalusha and FAZ within the last few hours letting the two know that the case is now officially over. This implies that the FAZ Elections will go ahead without The Icon on the ballot. This brings to a close a long-running saga which started in January.
In will be interesting now to see how the Damiano cases in court proceed since these were deemed by many as just proxy cases for Kalusha Bwalya.
Kindly find attached hereto both the letter by Kalusha Bwalya to CAS and the final letter from CAS.
Note that costs were awarded to FAZ in the preliminary round of the case and so these will be advised later and I shall update you at the right time.
