FOLLOW STATUTES WHEN RESOLVING CONFLICTS, FAZ ADVISES MEMBERS

The Football Association of Zambia (FAZ) had advised its members to follow the channels laid down in the Constitution when seeking a resolution to a football dispute.

According to a press statement by FAZ Acting Communications Manager Sydney Mungala made available to the ZamFoot Crew, The Association is concerned with the increase in the number of people seeking to resolve disputes outside the stipulated channels in the FAZ statutes.

“The Football Association of Zambia (FAZ) wishes to remind its members to abide by the constitution under any circumstances. FAZ has observed that some members have made it a habit to ignore provisions of the constitution and FIFA Statutes in their approach to football matters.

FAZ has repeatedly guided its members to respect its statutes and not seek to resolve football disputes outside the constitution.
Regrettably, the habit to resolve football matters through outside bodies is becoming entrenched and FAZ is deeply concerned with the status quo.”

FAZ went on to remind the Members of their obligations to the game as rightfully guided by statutes. According to Article 63 of the FAZ constitution football disputes are to be resolved as follows:

Article 63 Arbitration:
(1) Disputes in FAZ or disputes affecting Leagues, members of Leagues, Clubs, Players, and Officials shall not be submitted to Ordinary Courts, unless the FIFA regulations, these statutes or binding legal provisions specifically provide for a stipulate recourse to Ordinary Courts.

(2) Such disputes as specified in paragraph (1) above shall be taken to the Arbitration Tribunal recognized by FAZ or the Court of Arbitration for Sport (CAS) in Lausanne, Switzerland.

(3) As long as FAZ has not recognized or established any Arbitration Tribunal recognized by FAZ or the Court of Arbitration for Sport (CAS), in Lausanne, Switzerland. Any Arbitration Tribunal recognized or established by FAZ shall be in line with the Arbitration Act of Zambia or any salutatory modification thereto.

(4) Recourse may only be an Arbitration Tribunal in accordance with this article once all internal channels of FAZ have been exhausted.

FAZ has warned that any member who violates article 63 will be deemed to have forfeited their membership to FAZ by seeking recourse outside the provisions of the statutes.

Meanwhile, FAZ also took the time to advise its members to follow guidelines provided by the Ministry of Health and the World Health Organization (WHO) in combatting the Corvid-19 virus.
